Terms of Service

1. Acceptance of these Terms
These Terms of Service ("Terms") are a binding agreement between you and Epic Impact Media ("Epic Impact Media," "we," "us," or "our") that govern your use of epicimpactmedia.net (the "Site") and the services we provide. By using the Site, requesting a free Visibility Scorecard, opting in to our messages, or engaging our services, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Site or our services.
If you enter into a separate signed service agreement, statement of work, or order form with us, that document controls to the extent it conflicts with these Terms for the services it covers.
2. Eligibility and authority
You must be at least 18 years old and able to form a binding contract to use our services. If you use the Site or engage us on behalf of a business, you represent that you are authorized to bind that business to these Terms.
3. Our services
Epic Impact Media provides organic local search and AI-visibility services — Google Business Profile management and generative engine optimization (GEO) — for service businesses in the Research Triangle area of North Carolina. The specific deliverables, scope, and price for a paid engagement are described on our Services page and in the plan or agreement you select.
To keep our focus, we do not provide website builds, hosting, or redesigns; paid-advertising management; video or social-media production; email-marketing execution; brand or logo design; review removal or crisis PR; or pay-per-lead pricing. We are glad to refer you to specialists for those needs.
4. No guarantee of results
Search rankings, map placements, and AI-engine responses are controlled by third parties (such as Google, ChatGPT, and Perplexity) and depend on many factors outside our control, including those third parties' algorithms, your market, and your own business activity. We do not guarantee any specific ranking, map position, AI citation, impression, lead volume, revenue, or other business result. What we commit to is performing the visibility work described in your plan to a professional standard, with measured, dated reporting. Any timeframes we mention (for example, that GEO changes typically take 60–120 days to appear) are good-faith estimates, not promises.
5. The free Visibility Scorecard
The free Visibility Scorecard is a no-cost introduction based on publicly available data. It is provided "as is," with no obligation on either side, and does not by itself create a client relationship. Because it draws on live third-party data that changes over time, we do not warrant its accuracy or completeness. We may decline to provide, or stop providing, a scorecard at our discretion.
6. Fees, billing, cancellation, and refunds
Pricing and no long-term contract. Paid monthly plans are billed month-to-month, with no long-term contract and no setup fee, at the prices published on our Services page or in your order. One-time services (such as the GEO Audit & Roadmap) are billed as described at purchase.
Payment processing. Payments are processed by Stripe. By purchasing, you authorize us (through Stripe) to charge your selected payment method and you agree to Stripe's terms. You are responsible for keeping your payment information current.
Auto-renewal. Monthly plans automatically renew for successive one-month terms and bill in advance each period until you cancel. There is no separate renewal notice.
Cancellation. You may cancel a monthly plan at any time by emailing [email protected] or through any cancellation method we provide. Cancellation stops future renewals and takes effect at the end of the then-current billing period; you keep access through that period.
Refunds. Fees for the current and prior billing periods are non-refundable, and monthly fees are not prorated on cancellation, except where a refund is required by law or expressly stated in writing. One-time services are non-refundable once work has begun. Where we offer to credit a one-time audit fee toward a subsequent plan, the specific conditions stated at the time of that offer apply.
Late or failed payment. If a payment fails or is past due, we may suspend or stop services until payment is resolved.
7. Your responsibilities
You agree to:
- provide accurate, complete information and keep it current;
- grant and maintain the access a service requires (for example, manager access to your Google Business Profile) and promptly revoke it if you end the engagement;
- ensure that content, offers, and claims about your business are truthful and lawful, and that you hold the rights to any materials you give us;
- comply with all laws and platform rules that apply to your business, including advertising, consumer-protection, and review-solicitation rules (for example, no fake or incentivized reviews); and
- cooperate reasonably so we can perform the services.
You are solely responsible for your business, your products and services, and your dealings with your own customers.
8. Acceptable use of the Site
You agree not to misuse the Site — for example, by attempting to gain unauthorized access, interfering with its operation, scraping or copying it at scale, uploading malicious code, or using it to violate any law or the rights of others.
9. Communications consent
By providing your email address or phone number, you agree that we may contact you about your inquiry and services. Marketing emails and text messages are sent only where you have opted in or as otherwise permitted by law, and consent to marketing messages is not a condition of purchase. You can opt out of marketing emails using the unsubscribe link, and out of text messages by replying STOP. See our Privacy Policy for details. You consent to receive required notices and disclosures electronically.
10. Intellectual property
Ours. The Site and our original materials, methods, templates, scorecards, and reports — and all intellectual-property rights in them — are owned by Epic Impact Media. Except for the rights expressly granted here, we reserve all rights.
Yours. You retain ownership of your business content, trademarks, logos, and data. You grant us a limited, non-exclusive, revocable license to use them as needed to perform the services (including managing your profiles and creating posts and reports on your behalf).
Deliverables. On full payment, work product we prepare specifically for you (such as your profile optimizations and reports) may be used by you for your own business. Our pre-existing and general know-how, tools, and templates remain ours, and we may reuse the general skills and experience we develop.
Feedback. If you send us feedback or suggestions, we may use them without restriction or obligation to you.
11. Confidentiality
Each party will protect the other's non-public information disclosed in connection with an engagement and use it only to perform or receive the services, except where disclosure is required by law. We identify a client publicly only with that client's written permission; otherwise we describe our work anonymously by trade and town.
12. Third-party platforms
Our services rely on third-party platforms, including Google, GoHighLevel/LeadConnector, Stripe, and AI search engines. Your and our use of those platforms is subject to their terms, and we are not responsible for their availability, changes, pricing, policies, or actions, or for any loss caused by them.
13. Disclaimers
Except as expressly stated in these Terms or a signed agreement, the Site and services are provided "as is" and "as available," without warranties of any kind. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that the Site or services will be uninterrupted, error-free, or secure, or that any particular result will be achieved (see Section 4).
14. Limitation of liability
To the maximum extent permitted by law, Epic Impact Media and its owners and personnel will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or loss of goodwill, even if advised of the possibility. To the maximum extent permitted by law, our total cumulative liability for all claims arising out of or relating to the Site, the services, or these Terms will not exceed the total fees you paid to us in the three (3) months immediately preceding the event giving rise to the claim, or one hundred dollars ($100) if you have not paid us. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
15. Indemnification
You agree to defend, indemnify, and hold harmless Epic Impact Media and its owners and personnel from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your business, products, services, or content; (b) information or materials you provide to us; (c) your violation of these Terms or of any law or third-party right (including advertising, review, and intellectual-property rules); or (d) your breach of your representations here. We will notify you of any such claim and may participate in its defense with our own counsel at our expense.
16. Governing law and dispute resolution
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules.
Informal resolution first. Before filing anything, the parties agree to try to resolve any dispute informally by contacting each other and negotiating in good faith for at least 30 days after written notice of the dispute.
Venue. If the dispute is not resolved, you agree that it will be brought exclusively in the state or federal courts located in North Carolina, and you consent to the personal jurisdiction and venue of those courts. Each party may still seek injunctive relief for infringement or misuse of intellectual property or confidential information in any court of competent jurisdiction.
17. General
Entire agreement. These Terms, our Privacy Policy, and any signed service agreement are the entire agreement between us about their subject matter and supersede prior discussions.
Severability. If any provision is found unenforceable, the rest remains in effect and the unenforceable part will be limited or removed to the minimum extent necessary.
No waiver. Our failure to enforce a provision is not a waiver of it.
Assignment. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
Force majeure. Neither party is liable for delays or failures caused by events beyond its reasonable control (such as outages, third-party platform failures, natural events, or government action).
Relationship. We are an independent contractor; nothing here creates a partnership, joint venture, employment, or agency relationship.
Notices. Legal notices to us should go to [email protected] and the mailing address below; we may give you notice by email or through the Site.
18. Changes to these Terms
We may update these Terms from time to time. When we make a material change, we will revise the "Last updated" date above and post the new version on this page. Your continued use of the Site or services after an update means you accept the revised Terms.
